How long does divorce take in Ontario?

In Canada, you must be separated for at least one year before a divorce is granted (unless proceeding on grounds of adultery or cruelty). Once you apply, an uncontested divorce typically takes 4–6 months to process through the courts. A contested divorce involving custody or property disputes can take considerably longer — sometimes 1–3 years or more depending on complexity. We work to resolve matters as efficiently as possible for you.

Who pays child support in Ontario?

In Ontario, child support is calculated using the Federal Child Support Guidelines based primarily on the paying parent's gross annual income and the number of children. The parent who has the children less than 40% of the time typically pays support. Both parents may also share "special and extraordinary expenses" (Section 7 expenses) such as daycare, medical costs, and extracurricular activities, proportionate to their incomes.

What is decision-making responsibility in Ontario family law?

Ontario updated its family law terminology in 2020. "Custody" is now called "decision-making responsibility" — the right to make major decisions about a child's education, health, religion, and extracurricular activities. "Access" is now "parenting time" — the time a child spends with each parent. This change reflects a more child-centred approach. Courts determine these arrangements based on the best interests of the child.

Do I need a lawyer for a separation agreement?

You are not legally required to have a lawyer, but it is strongly advisable. Without independent legal advice, a separation agreement can later be challenged and set aside by a court. A lawyer ensures your agreement is legally sound, comprehensive, and that you fully understand what you are agreeing to. Both parties should ideally have independent legal advice — it protects everyone and gives the agreement far greater legal standing.

What is collaborative family law?

Collaborative family law is a process where both parties and their lawyers commit in writing to resolving all issues outside of court through structured meetings and negotiation. It often involves financial and mental health professionals to assist the process. It tends to be less adversarial, less expensive, and less damaging to co-parenting relationships than litigation. Anna Boulman is a trained collaborative law practitioner.

How is family property divided in Ontario?

Ontario uses the equalization of net family property system. Each spouse calculates the difference between their net worth on the date of marriage and their net worth on the date of separation. The spouse with the higher "marriage gain" pays half the difference to the other. The matrimonial home has special rules — it's always included regardless of who owned it before marriage. Property brought into the marriage (with certain exceptions) is generally excluded.
